ZMPSiŚ S.A. as part of the ship waste collection system operating on the basis of the Act on port facilities for the reception of waste from ships of May 12, 2022 (Journal of Laws of 2022, item 1250, as amended) and in accordance with the current Management Plans Waste for the seaport of Szczecin and the seaport of Świnoujście, approved by the Marshal of the West Pomeranian Voivodeship, ensures the collection of waste described in Article 5, point 5 and point 10 of the above Act, generated during ship operation or loading and unloading and cleaning, which are covered by the scope of application of Annexes I , II, IV, V and VI to the MARPOL Convention, passively caught waste, including cargo residues from ships. ZMPSiŚ S.A. ensures the collection of cargo residues from ships in accordance with the procedures described in the Waste Management Plans for Szczecin and Świnoujście, according to their types and quantities, and for a fee in accordance with the provisions of the Tariff of fees for services (see table 4. "Fees for the collection of cargo residues from ships") . ZMPSIŚ S.A. reserves the right to verify cargo residues and waste covered by Annex II of the Marpol Convention in terms of their harmfulness and danger to health and the marine environment before their receipt. Fees for the collection of this waste will be collected in accordance with the current Tariff of fees for services, according to the type of waste determined by the company providing the waste collection service.
Collection of cargo residues may take place without the participation of ZMPSIŚ. Then, the cargo recipient, as the ordering party for the collection of such waste, ensures the collection of cargo residues from the ship on his own. The cargo consignee bears full legal and financial responsibility for the collection of cargo residues from ships. The recipient of the cargo, guided by commercial principles, is obliged to commission the collection of such waste to a company that complies with the applicable legal provisions regarding the collection of waste from ships and meets the following conditions:
1) having a registration number assigned by the marshal of the voivodeship appropriate to the entity's registered office and having an entry in the BDO. in terms of, at least, the transport and/or collection of hazardous or non-hazardous waste;
2) informed in writing the Director of the Maritime Office in Szczecin about starting and conducting activities related to the collection, storage and management of waste in the area of the sea port in Szczecin.
3) is included in the "list" of companies providing this type of service at the sea port in Szczecin and/or Świnoujście, kept by the Szczecin and Świnoujście Seaports Authority S.A.
The companies, after prior reporting to the Energy and Operations Department of the Szczecin and Świnoujście Seaports Authority S.A. and after a positive assessment of the above documents provided by this department, they will be able to provide this type of service in the sea port of Szczecin or Świnoujście. These companies will be included in the "list", which is constantly updated and available on the website of ZMPSiŚ S.A. www.port.szczecin.p,, BIP.
The company collecting cargo residues operates at its own expense and risk, taking into account the requirements of applicable law, in particular the provisions of the Waste Act regarding permits and port regulations regarding conducting business in port areas. Moreover, this company is responsible for any damage to the environment resulting from incorrect performance of the service of collecting cargo residues from ships.
The procedure for collecting cargo residues from ships and the obligations of the company collecting such waste from ships are described in detail in the Waste Management Plans for the seaport of Szczecin and the seaport of Świnoujście, and failure to comply with them results in the companies being removed from the list.
